These sales terms govern the sale of products marketed by Azienda Agricola La Badiola S.r.l. (hereinafter referred to as LaBadiola.it) through the website www.labadiola.it. All purchase contracts for products concluded via the aforementioned website and in accordance with the procedures indicated herein between the seller and the Customer will be governed by these sales terms (in accordance with Italian law, specifically Legislative Decree 70/2003 on electronic commerce and Legislative Decree 206/2005 with specific reference to distance contracts). Any changes or new sales terms will be promptly communicated to the Customer, will be effective from the time of their publication on the website, and will apply only to sales concluded after the date of publication.
Acceptance of Sales Terms
The contract between LaBadiola.it and the Customer is considered concluded upon acceptance of the order by LaBadiola.it. Acceptance is considered tacit unless otherwise communicated to the Customer by any means. By placing an order through the methods provided, the Customer declares to have read the information provided during the purchase procedure and to accept the conditions set out below. Therefore, the Customer is invited to carefully read these sales terms and to print or save them on another durable medium accessible to them.
The images on the site are provided to help the Customer recognize the products and, due to possible variations in packaging by the manufacturer, the photos may not exactly reflect the appearance of the delivered product.
Purchase Methods
The Customer may only purchase the products listed on the LaBadiola.it website at the time of the order submission, as described in the relevant information sheets. The correct receipt of the order is confirmed by LaBadiola.it via an email sent to the email address provided by the Customer. This confirmation message will include the date and time of the order and an “Order Number” to be used in any further communication with LaBadiola.it, as well as a reference to these sales terms. In the event of non-acceptance of the order, LaBadiola.it commits to promptly inform the Customer. All prices listed on the site are public prices, including VAT. LaBadiola.it reserves the right to change prices at any time without notice.
Payment Methods
The Customer may purchase the products on the LaBadiola.it website using the different payment methods indicated during the purchase procedure.
Delivery Methods
LaBadiola.it delivers its products via specialized couriers. Shipping costs are generally borne by the Customer and are clearly stated at the time of the order. Depending on the destination area, deliveries may take from 48 hours to 20 working days, barring unforeseen circumstances due to customs delays or peak periods. Upon receiving the goods, the Customer must check the integrity of the packaging. If in doubt about the integrity, the Customer must note it on the delivery receipt. The Customer has 14 working days to verify the integrity of the goods and report any damage in writing via email to info@labadiola.it. Within 14 working days, LaBadiola.it will proceed with the refund.
Right of Withdrawal
The Customer has the right to withdraw from the contract, without stating any reason, within 14 days. The withdrawal period expires 14 days from the day the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods. To exercise the right of withdrawal, the Customer must inform LaBadiola.it of their decision to withdraw via an explicit declaration sent to the contacts above (for example by letter, fax, or email). To meet the withdrawal deadline, it is sufficient for the Customer to send the notice before the expiration of the 14-day period. If the Customer withdraws from this contract, all payments made to LaBadiola.it will be refunded, including delivery costs, without undue delay and in any case no later than 14 days from the day LaBadiola.it is informed of the decision. Refunds will be made using the same payment method used by the Customer, unless otherwise agreed; in any case, the Customer will not incur any fees as a result. The Customer must return the goods to LaBadiola.it without undue delay and in any case within 14 days from the notice of withdrawal. The deadline is met if the goods are sent before the 14-day period expires. Return shipping costs are the Customer’s responsibility. The Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Products that are damaged or used, even partially, will not be refunded or replaced. The right of withdrawal does not apply to: custom-made or clearly personalized items or those which, by their nature, are likely to deteriorate rapidly, are sealed and not suitable to be returned for hygiene reasons or health protection and have been opened after delivery. For wine tasting tours requiring prepayment, the Customer may withdraw from the contract, without stating reasons, up to 72 hours before the event. After this deadline, 50% of the total amount will be withheld. In case of no-show or cancellation within 24 hours before the event, the full amount will be withheld.
Protection of Minors
LaBadiola.it does not sell wine or other alcoholic products to individuals under 18 years old (in Italy). The courier will not deliver wine or other alcoholic products to individuals under 18 and may request an ID to verify age, including for EU and non-EU countries where the legal age for purchasing alcohol differs from 18.
Jurisdiction and Applicable Law
The sales contract between the Customer and LaBadiola.it is deemed to be concluded in Italy and governed by Italian law. For any civil or criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, jurisdiction lies with the court of their place of residence; in all other cases, jurisdiction is exclusively that of the Court of Lucca. 22/01/2020
