These sales terms govern the sale of products marketed by Azienda Agricola La Badiola S.r.l. (hereinafter referred to as LaBadiola.it) through the website www.labadiola.it. All purchase contracts for products concluded via the aforementioned website and in accordance with the procedures indicated herein between the seller and the Customer will be governed by these sales terms (in accordance with Italian law, specifically Legislative Decree 70/2003 on electronic commerce and Legislative Decree 206/2005 with specific reference to distance contracts). Any changes or new sales terms will be promptly communicated to the Customer, will be effective from the time of their publication on the website, and will apply only to sales concluded after the date of publication.
Acceptance of Sales Terms
The contract between LaBadiola.it and the Customer is considered concluded upon acceptance of the order by LaBadiola.it. Acceptance is considered tacit unless otherwise communicated to the Customer by any means. By placing an order through the methods provided, the Customer declares to have read the information provided during the purchase procedure and to accept the conditions set out below. Therefore, the Customer is invited to carefully read these sales terms and to print or save them on another durable medium accessible to them.
The images on the site are provided to help the Customer recognize the products and, due to possible variations in packaging by the manufacturer, the photos may not exactly reflect the appearance of the delivered product.
Purchase Methods
Il Cliente può acquistare solo i prodotti presenti sul sito LaBadiola.it al momento dell’inoltro dell’ordine così come descritti nelle relative schede informative. La corretta ricezione dell’ordine è confermata da LaBadiola.it mediante una risposta via e-mail, inviata all’indirizzo di posta elettronica comunicato dal Cliente. Tale messaggio di conferma riporterà data e ora di ricezione dell’ordine ed un “Numero Ordine”, da utilizzarsi in ogni ulteriore comunicazione con LaBadiola.it, così come un rimando alle presenti condizioni di vendita. Nel caso di mancata accettazione dell’ordine, LaBadiola.it si impegna ad una tempestiva comunicazione al Cliente. Tutti i prezzi presenti nel sito sono da intendersi prezzi al pubblico e, quindi, comprensivi di iva. LaBadiola.it si riserva il diritto di modificare i prezzi in ogni momento, senza alcun preavviso.
Payment Methods
The Customer may purchase the products on the LaBadiola.it website using the different payment methods indicated during the purchase procedure.
Delivery Methods
LaBadiola.it delivers its products via specialized couriers. Shipping costs are generally borne by the Customer and are clearly stated at the time of the order. Depending on the destination area, deliveries may take from 48 hours to 20 working days, barring unforeseen circumstances due to customs delays or peak periods. Upon receiving the goods, the Customer must check the integrity of the packaging. If in doubt about the integrity, the Customer must note it on the delivery receipt. The Customer has 14 working days to verify the integrity of the goods and report any damage in writing via email to info@labadiola.it. Within 14 working days, LaBadiola.it will proceed with the refund.
Right of Withdrawal
The Customer has the right to withdraw from the contract, without providing any reason, within 14 days. The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, acquires physical possession of the goods. To exercise the right of withdrawal, the Customer must inform LaBadiola.it of their decision to withdraw by means of an explicit statement sent to the contact details provided above (for example, by letter sent by post, fax, or email).
Digital withdrawal function
Without prejudice to the other methods for exercising the right of withdrawal indicated in these general terms and conditions, the Consumer may also exercise this right through the digital function called “Withdraw from the contract here”, available on this web page.
The function allows the Consumer to provide or confirm their name, the information necessary to identify the contract or order they wish to withdraw from, and the electronic contact details where they wish to receive confirmation.
Once the online withdrawal declaration has been completed, the Consumer may submit it using the “Confirm withdrawal” function or another equivalent and unequivocal wording.
Following submission, La Badiola will send the Consumer, without undue delay and on a durable medium, an acknowledgement of receipt containing the submitted declaration, as well as the date and time of its transmission.
The right of withdrawal shall be deemed exercised within the required time limit if the online withdrawal declaration is submitted by the Consumer before the expiry of that period.
To comply with the withdrawal period, it is sufficient for the Customer to send the notice concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
If the Customer withdraws from this contract, all payments made in favour of LaBadiola.it, including delivery costs, will be refunded without undue delay and in any event no later than 14 days from the day on which LaBadiola.it is informed of the Customer’s decision to withdraw from this contract.
Such refunds will be made using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not incur any costs as a consequence of such refund.
The Customer is requested to return the goods and deliver them to LaBadiola.it without undue delay and, in any event, within 14 days from the day on which they communicated their withdrawal from this contract. The deadline is met if the Customer returns the goods before the expiry of the 14-day period.
The costs of returning the goods shall be borne by the Customer. The Customer is only responsible for any decrease in the value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
Damaged or used products, even partially, will not be replaced or refunded. The right of withdrawal does not apply to: goods made to measure or clearly personalised; goods which, by their nature, are liable to deteriorate rapidly; sealed goods which are not suitable for return for reasons of hygiene or health protection and which have been opened after delivery.
The Customer who has purchased a tasting tour, for which advance payment is required, has the right to withdraw from the contract, without providing any reason, up to 72 hours before the date of the event. After this deadline, 50% of the total amount will be retained. In the event of a no-show or cancellation within 24 hours before the booking date, the entire amount will instead be retained.
Protection of Minors
LaBadiola.it does not sell wine or other alcoholic products to individuals under 18 years old (in Italy). The courier will not deliver wine or other alcoholic products to individuals under 18 and may request an ID to verify age, including for EU and non-EU countries where the legal age for purchasing alcohol differs from 18.
Jurisdiction and Applicable Law
The sales contract between the Customer and LaBadiola.it is deemed to be concluded in Italy and governed by Italian law. For any civil or criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, jurisdiction lies with the court of their place of residence; in all other cases, jurisdiction is exclusively that of the Court of Lucca. 22/01/2020
